2. Products

We sell watches, straps, accessories and related products under the NIVARI brand.

Product images are for illustrative purposes. Due to lighting, screen settings and natural variations in materials and finishes, the actual appearance of a product may vary slightly from the images shown.

Minor variations in colour, brushing, polishing, dial texture or material appearance do not constitute a defect where they are within normal manufacturing and material tolerances.

3. Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order.

By placing an order through the checkout, you submit a binding offer to purchase the selected products.

A contract is concluded when we accept your order by sending an order confirmation or by dispatching the goods.

4. Prices and Payment

All prices are shown in the currency displayed at checkout.

Prices may include VAT where applicable, depending on the customer’s location, tax rules and checkout settings.

Shipping costs, customs duties, import taxes or other charges may apply depending on the delivery destination and will be displayed where technically possible or charged by the relevant authorities.

Payment is processed through the payment methods offered at checkout, including Shopify Payments, Stripe, PayPal and Klarna where available.

5. Reservations and Pre-Orders

If reservations or pre-orders are offered, the specific terms shown on the respective product or reservation page apply.

Reservation payments may secure priority access, a pre-order position or a launch benefit, depending on the offer described at the time of reservation.

Unless expressly stated otherwise, a reservation does not guarantee final product availability, delivery date or acceptance of a future order.

6. Delivery and Shipping

Delivery times are stated on the product page, checkout page or order confirmation where available.

Delivery times are estimates and may vary due to production, customs processing, logistics delays or other circumstances outside our direct control.

If a delivery cannot be completed because the customer provided incorrect delivery information or failed to accept the shipment, the customer may be responsible for additional shipping costs.

7. Customs, Duties and Import Taxes

For deliveries outside the European Union, customs duties, import taxes, handling fees or other charges may apply.

These charges are usually collected by customs authorities, shipping providers or local authorities and are the responsibility of the customer unless explicitly stated otherwise at checkout.

Customers are responsible for complying with the import regulations of their country.

8. Retention of Title

The goods remain our property until full payment has been received.

9. Right of Withdrawal

Consumers have a statutory right of withdrawal.

10. Warranty and Defects

Statutory warranty rights apply.

If a product is defective, please contact us at info@nivariwatches.com and include your order number, a description of the issue and, where possible, photos or videos showing the defect.

Normal wear and tear, scratches caused by use, damage caused by accidents, improper handling, unauthorized repairs, modifications or external influences are not covered as defects.

Mechanical watches are precision instruments. Minor deviations within the stated or manufacturer-accepted tolerance range do not constitute a defect.

11. Bracelet Sizing and Wear

If a bracelet is resized, adjusted or modified, this may affect the resale condition of the product.

Customers are responsible for ensuring that sizing, adjustment or handling is carried out carefully and appropriately.

Wear marks caused by normal contact between moving bracelet or clasp components may occur over time and do not automatically constitute a defect.

12. Limitation of Liability

We are liable without limitation for intent, gross negligence, injury to life, body or health, and where mandatory statutory liability applies.

In cases of slight negligence, we are only liable for breaches of essential contractual obligations. In such cases, liability is limited to foreseeable, typical contractual damages.

Essential contractual obligations are obligations whose fulfilment is necessary for the proper performance of the contract and on whose compliance the customer may regularly rely.

13. Intellectual Property

All brand names, logos, product designs, images, texts and other content on this website are protected by intellectual property rights.

The use, reproduction, modification or distribution of such content without prior written permission is prohibited.

NIVARI is a brand operated by Watch Design Industries.

14. Contract Language

The contract language is English, unless another language is expressly offered during the order process.

15. Applicable Law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.

For consumers, this choice of law applies only insofar as it does not deprive the consumer of mandatory consumer protection provisions of the country in which the consumer has their habitual residence.

16. Consumer Dispute Resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

17. Severability

If any provision of these Terms and Conditions is invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
